## Short answer

If you believe a YouTube copyright strike is a mistake, you can wait 90 days and complete Copyright School (the video stays down), ask the claimant for a retraction, or file a counter-notification through YouTube Studio. YouTube forwards a valid counter-notification to the claimant, who then has 10 US business days to show legal action.

## Summary

- A copyright strike (takedown) is not the same as a Content ID claim.
- Counter-notifications share your contact details with the claimant.
- YouTube gives claimants 10 US business days after a valid counter-notification.
- s.43H/s.43I are Malaysian law for service providers; do not merge them with YouTube's US-style form.
- Fees for help in Malaysia are quoted in MYR after review; elsewhere in USD after review.

If you believe a YouTube copyright strike is a mistake, you can wait 90 days and complete Copyright School (the video stays down), ask the claimant for a retraction, or file a counter-notification through YouTube Studio. YouTube forwards a valid counter-notification to the claimant, who then has **10 US business days** to show legal action. Malaysia's Copyright Act 1987 **s.43H** sets a local notice-and-counter-notice framework for service providers; YouTube's form still follows YouTube's own process. This is not legal advice.

## I got a copyright strike I think is false. What are my options?

YouTube lists three paths: complete Copyright School and wait **90 days** for the strike to expire (the video is not reinstated), contact the claimant for a **retraction**, or submit a **counter-notification** if you believe the removal was a mistake or misidentification, including a copyright exception such as fair dealing. Start from the copyright notice in YouTube Studio. See [About copyright removal requests](https://support.google.com/youtube/answer/13823830).

## Strike vs Content ID claim vs scheduled removal

A **copyright removal request** that YouTube accepts removes the content and applies a **copyright strike**. A **Content ID claim** is different: monetisation or muting can apply without a strike. **Scheduled** removals give about **7 days** to delete the video, seek a retraction, or cancel a related Content ID appeal before the strike lands; YouTube says counter-notifications cannot be filed until the removal is effective ([About copyright removal requests](https://support.google.com/youtube/answer/13823830)). Confirm which notice you received before you act.

## Your three options

## Wait 90 days and complete Copyright School

YouTube says strikes expire after 90 days if you finish Copyright School. The video stays down. This avoids sharing your address with the claimant, but it does not restore the upload.

## Ask the claimant for a retraction

If you know who filed, you can ask them to retract. Keep communication factual and save copies. Retraction is voluntary; nobody can force it through a blog post.

## File a counter-notification

Use this only if you have a good-faith belief the removal was a mistake or misidentification. False statements can create legal risk. YouTube's steps are in [Submit a copyright counter notification](https://support.google.com/youtube/answer/2807684).

## How to file a YouTube counter-notification

On a computer (or the Studio app), YouTube's help page describes:

1. Sign in to **YouTube Studio** → **Content** → filter **Copyright**.
2. Find a video with **Removed** visibility → under Restrictions, open copyright details → **Submit a counter notification**.
3. Confirm you understand the requirements.
4. Enter **contact info**, including a complete **physical address** and **full legal name** (first and last; not a company or channel name).
5. Explain briefly why the removal was a mistake or misidentification.
6. Agree to the **two legal statements** YouTube requires (jurisdiction/service of process, and the perjury statement about mistake or misidentification).
7. Sign with your **full legal name** and submit.

YouTube also allows email/fax/mail to copyright@youtube.com for some content types, with specific URL formats. An **authorised representative** (such as a lawyer) can submit if you do not want to disclose personal details yourself. Misuse of the process can lead to account termination or other legal consequences ([YouTube Help](https://support.google.com/youtube/answer/2807684)).

## What personal details does a counter-notification reveal?

YouTube states it is legally required to share the counter-notification with the claimant. That typically includes your name, address, telephone number and statements. If disclosure is a concern, use an authorised representative through the channels YouTube lists.

## What happens after I file?

If YouTube finds the counter-notification valid and forwards it, the claimant has **10 US business days** to respond with evidence of legal action that keeps the content down. If they do not, YouTube says the content can be reinstated (unless you deleted it). Status appears under the copyright details in Studio. You can cancel a counter-notification before the claimant responds by following YouTube's email instructions ([Respond to a counter notification](https://support.google.com/youtube/answer/12497556); [Submit a counter notification](https://support.google.com/youtube/answer/2807684)).

## What does Malaysia's Copyright Act 1987 s.43H say?

Part VIB of the Copyright Act 1987 (Act 332) limits service-provider liability and includes **s.43H** ("Notification by copyright owner and its effect"). In the official MyIPO reprint:

- A copyright owner may notify a service provider to remove or disable access to an infringing electronic copy; the provider must act within **48 hours** of receiving a valid notification (s.43H(2)).
- The affected person may issue a **counter notification** (s.43H(3)).
- The provider must send the counter notification to the original notifier and restore the material **not less than ten business days** later, unless the notifier says it has filed a court action (s.43H(4)).
- s.43H(5) lists required contents of a counter notification (signature, identification of the material, perjury statement, name/address/telephone, consent to jurisdiction).

For disputed ownership or a lawsuit, see a Malaysian lawyer.

## Can someone who files a false notice face consequences in Malaysia (s.43I)?

**s.43I** makes a person who knowingly makes a false material statement in a s.43H notification guilty of an offence: a fine up to **the quoted fee**, imprisonment up to **five years**, or both, plus liability to compensate anyone who suffers loss. It can apply even if the statement was made outside Malaysia. That is about false notifications under Malaysian law; it is not a button inside YouTube Studio. Get legal advice before relying on it.

## Should I ask for a retraction or wait 90 days instead?

Choose based on risk. Retraction keeps your address private if the claimant agrees. Waiting 90 days with Copyright School clears the strike without restoring the video. A counter-notification aims to reinstate content but shares your details and can trigger litigation. YouTube also publishes tips on abuse of copyright tools ([Tips for copyright removals](https://support.google.com/youtube/answer/15575746)) and strike basics ([Understand copyright strikes](https://support.google.com/youtube/answer/2814000)).

## The "copyright" email asks me to click a link or log in. Is it real?

Treat unexpected copyright emails with login links, crypto invoices or "agent" chat as phishing until you verify inside **YouTube Studio** while logged in through youtube.com. ## When AwareXone can help

AwareXone can help organise an evidence pack, review whether the notice looks like a strike vs Content ID vs phishing, and secure a channel after a compromise. We have handled **1,300+** account cases with names kept anonymous. We never ask for your Google password or 2-Step codes, and we do not promise a strike will be removed. Malaysia work is quoted in **MYR after review**; other countries in **USD after review**. Start at [case review](https://www.awarexone.com/contact?interest=account-recovery-case). > "Counter" - notifications are legal documents, not support tickets. Read YouTube's two required statements, decide whether you can stand behind them, and keep Malaysian s.43H separate from YouTube's own timeline." - Md Shariar Shanaz Shuvon, Founder, AwareXone

### Is fair dealing an automatic win?

No. Fair dealing is not a blanket defence. Only file if you have a good-faith belief the removal was a mistake or misidentification.

### Can I counter-notify if my channel is terminated?

Follow YouTube's help for terminated channels and copyright; some steps differ. See [YouTube channel terminated appeal](https://www.awarexone.com/research/youtube-channel-terminated-appeal).

### Does s.43H force YouTube to restore my video in ten days?

s.43H binds service providers under Malaysian law when that framework applies. YouTube's product help describes its own 10 US business day claimant response period. Do not treat them as one rule.

### What if the claimant files a court case?

Stop guessing from forums. Speak to a lawyer in your jurisdiction promptly.

### Will AwareXone file the counter-notification for me?

Any filing must be truthful and usually needs the uploader or an authorised representative. We help with process and evidence; we do not invent ownership claims.

### Are fees published here?

No. Malaysian cases are quoted in MYR after review; others in USD after review. --- Sources: - Copyright Act 1987 (Act 332), MyIPO reprint - https://www.myipo.gov.my/wp-content/uploads/2025/09/Copyright-Act-1987-Act-332.pdf - YouTube counter notification - https://support.google.com/youtube/answer/2807684 - YouTube respond to counter notification - https://support.google.com/youtube/answer/12497556 - YouTube about copyright removal requests - https://support.google.com/youtube/answer/13823830 - YouTube tips for copyright removals - https://support.google.com/youtube/answer/15575746 - YouTube copyright strike basics - https://support.google.com/youtube/answer/2814000
